Court Grants Final Approval of Sweetwater Union High School District Data Breach Settlement

On April 3, 2026, Judge Gregory W. Pollack of the San Diego County Superior Court granted final approval of the class action settlement in Jane Roe, et al. v. Sweetwater Union High School District, Case No. 37-2023-00028588-CU-BT-CTL. The settlement resolves claims arising from a February 2023 data breach in which an unauthorized third party gained access to the District’s network and files containing the personal information of current and former employees and students, including names, Social Security numbers, financial account information, and health care information.

What the Settlement Provides

Class members who submitted timely and valid claim forms are eligible to receive:

  • One year of free credit monitoring upon registration with a Unique ID from the class notice;
  • Reimbursement of up to $5,000 for documented, unreimbursed out-of-pocket losses fairly traceable to the data breach, including bank fees, unauthorized charges, credit freeze costs, and related expenses;
  • Up to $100 as compensation for time spent addressing issues related to the incident; and
  • Up to $5,000 for documented instances of identity fraud, at $250 per verified occurrence.

The District has also agreed to implement and maintain additional data security measures going forward. Attorneys’ fees, litigation costs, service awards to the class representatives, notice, and claims administration are being paid separately by the District and will not reduce the compensation available to class members.

What Happens Next

With final approval now entered, the settlement administrator, Simpluris, will begin processing timely claims submitted before the January 26, 2026 deadline. The settlement will become final in June 2026, and Simpluris will begin issuing payments to eligible class members whose claims are approved during the Summer of 2026. Claimants do not need to take any further action at this time. As payments will be distributed after the judgment becomes final and all claims have been processed, as with any class action settlement, claimants should allow time for this process to run its course.
